Title 84

Hi Richard as you saw I had a reply from Brian but he didn't answer any of
my questions, please let me know if you think the questions were in any way
unreasonable, the problem I have is where to go from here.
Do you really want me to go down the official complaint and LGO road? It's
expensive and time consuming for all involved, produces bad publicity for
the council I don't really think anyone benefits.

Could you perhaps come up with some sort of compromise of alternative all I
really want to see is the site cleared up for the summer and a building
that conforms to the EAs safety recommendations, I can't think of any reason why
you Brian or anyone else would want anything different.

Best regards Michael

Dear Michael

I think you have already had a fairly clear indication from us that as
matters stand at present there is unlikely to be any temporary summer use this
year. However if that situation should change then of course we will be letting
people in Ramsgate know.

To turn to your questions.

1. My understanding is that once development has commenced - and this could
be by any activity related to the approval and is a matter of fact and
degree - then the permission remains open.

2. I am unable to comment on matters of commercial agreement between the
Council and SFP Ventures .

3. I am unable to comment for the same reasons set out above.

I hope this clarifies the present position for you.

Richard Samuel
Chief Executive
Thanet District Council

Thanks Richard I appreciate you making the effort and understand my
questions may be difficult to answer.

With regard to question 1 it strikes me as odd that this permission stands
in perpetuity, so there is a very real possibility we will have a road layout
that has been wrongly build and an abandoned building site in another 5
years.

With regard to question 2 I already have it in writing from my ward
councillor that the bond had not been placed when the 5 years had expired, so I am
not asking you to reveal preferential commercial information.

As work started before the bond was placed I am asking you as chief
executive if the council and SFP acted within the law in this matter, this is a
courtesy from me I could have immediately reported the matter to the serious
economic crime unit.

With regard to question 3 I am not asking to see the document in question I
am just asking if it exists, as you and I both know that if it doesn't there
is potential for a very serious crime indeed.
Perhaps you would like to reconsider your answers to some degree at the
moment it is obvious to me that there is something very wrong here, it can’t have
escaped your notice that the bond having to be placed before work begins and
the planning permission not having expired because work has begun do not
hang well together.
Best regards Michael

Dear Michael

Thank you for your email which clarifies the direction of your questioning in a way I had not fully appreciated from your first enquiry.

I suspect the answers to your questions will lie within the terms of the draft development agreement and will require a little research to establish the trail.

I will come back to you with a fuller reply as soon as I can.
